MATINÉ AS ("MATINÉ", "we", "us" or "our") operates the website and online store at matinecosmetics.com (the "Services"). This Privacy Policy explains how we collect and use personal information when you visit our website, place an order, subscribe to marketing or contact us.

1. Who is responsible for your personal information?

2. Personal information we collect

Depending on how you interact with the Services, we may collect:

  • Contact and delivery information, such as your name, email address, telephone number, billing address and delivery address.

  • Order and transaction information, such as the products you view, place in your cart or purchase, order value, payment method, payment status, delivery information, and information relating to cancellations, returns or refunds.

  • Payment-related information. Payments are processed by payment providers made available at checkout, including Vipps and card-payment providers. These providers process the payment credentials needed to complete the transaction. We generally receive payment confirmation and limited transaction details rather than your full payment-card details.

  • Marketing information, such as your email address, subscription status and interactions with marketing emails, when available.

  • Communications, including information you provide when you contact us or request customer support.

  • Device and usage information, such as IP address, browser type, device information, cookie identifiers, and information about how you use the Services.

  • Security information, such as information used to detect, investigate and prevent fraud, misuse or other harmful activity.

We do not ask you to create a customer account, and the Services do not currently offer wishlists or product reviews.

3. How we collect personal information

We collect personal information:

  • directly from you, including when you place an order, subscribe to marketing or contact us;

  • automatically when you use the Services, including through cookies and similar technologies;

  • from Shopify and providers that support our store, payments, delivery, communications, security and other business operations; and

  • from other parties where permitted by law.

4. Why we use personal information and our legal bases

We use personal information for the following purposes:

  • To process, fulfil and deliver orders; take payment; provide order updates; and manage cancellations, returns and refunds. The legal basis is that the processing is necessary to enter into or perform our contract with you.

  • To respond to questions and provide customer service. The legal basis is our contract with you where the request concerns an order, or our legitimate interest in responding to enquiries and providing effective customer service in other cases.

  • To send marketing emails. The legal basis is your consent. You may withdraw your consent at any time by using the unsubscribe link in an email or contacting us. Withdrawing consent does not affect processing that occurred before withdrawal.

  • To operate, secure and improve the Services; prevent fraud and misuse; troubleshoot technical issues; and understand store performance. The legal basis is our legitimate interest in running a secure, reliable and effective online store. Where the law requires consent for non-essential cookies or similar technologies, we rely on your consent instead.

  • To comply with accounting, tax, consumer-protection and other legal obligations, and to respond to valid requests from public authorities. The legal basis is compliance with a legal obligation.

  • To establish, exercise or defend legal claims. The legal basis is our legitimate interest in protecting our legal rights.

Where we rely on legitimate interests, we consider whether our interests are necessary and proportionate and balance them against your rights and interests.

5. Cookies and similar technologies

We and Shopify use cookies and similar technologies to operate and secure the Services, remember choices, understand website use and, where enabled and permitted, measure performance.

Our cookie banner is shown to visitors in Norway. You can accept, decline or manage non-essential cookies through the banner. Strictly necessary cookies may be used without consent where permitted because the Services cannot function properly without them. You can revisit your cookie choices using the cookie-preference control available on the website, if displayed, or through your browser settings.

MATINÉ does not currently use advertising pixels or Shopify Network Intelligence. If this changes, we will update this Privacy Policy and our consent settings as required before using the relevant data.

6. Marketing communications

If you choose to subscribe, we use your email address to send MATINÉ news, product information and promotional communications through Shopify's email service. You can unsubscribe at any time using the link in any marketing email or by contacting us at hello@matinecosmetics.com.

Even if you unsubscribe from marketing, we may still send necessary non-promotional messages about your orders, customer-service requests or legal matters.

7. How we share personal information

We share personal information only where necessary for the purposes described above, including with:

  • Shopify, which hosts and supports our online store and related services;

  • payment providers, including Vipps and the card-payment providers made available at checkout;

  • delivery and logistics providers selected to fulfil and deliver your order;

  • communications and email-service providers, including Shopify's email service;

  • professional advisers and operational service providers, where needed for services such as accounting, legal advice, IT, security or fraud prevention; and

  • public authorities, courts or other parties where disclosure is required by law or necessary to establish, exercise or defend legal claims.

We may also disclose personal information in connection with a merger, acquisition, restructuring or sale of all or part of our business, subject to applicable law.

We do not sell your personal information.

8. Shopify

The Services are hosted by Shopify. Shopify processes personal information to provide and improve the commerce services used by our store. Information processed through the Services may be shared with Shopify and its subprocessors. You can learn more in the Shopify Consumer Privacy Policy.

9. International transfers

Some of our service providers, including Shopify and its subprocessors, may process personal information outside Norway or the European Economic Area (EEA).

Where personal information is transferred to a country that has not been recognised as providing an adequate level of protection, the transfer must be protected by an approved safeguard, such as the European Commission's Standard Contractual Clauses, together with supplementary measures where required. You may contact us for more information about the safeguards relevant to your personal information.

10. How long we retain personal information

We retain personal information only for as long as necessary for the purposes described in this Privacy Policy, including to fulfil orders, provide customer service, prevent fraud, resolve disputes and comply with legal obligations.

Order and transaction records that form part of our accounting documentation are generally retained for five years after the end of the relevant financial year, or longer where applicable law requires it. Marketing information is retained until you withdraw your consent or we no longer need it for the stated purpose. Other information is deleted or anonymised when it is no longer needed, unless continued retention is required or permitted by law.

11. Security

We use appropriate technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Please do not send sensitive payment or other confidential information to us through unsecured communication channels.

12. Your rights

Subject to the conditions and exceptions in applicable law, you may have the right to:

  • receive information about how we process your personal information;

  • request access to your personal information;

  • request correction of inaccurate or incomplete information;

  • request deletion of your personal information;

  • request restriction of processing;

  • object to processing based on legitimate interests;

  • receive certain personal information in a structured, commonly used and machine-readable format and, where applicable, have it transferred to another controller;

  • withdraw consent at any time where processing is based on consent; and

  • lodge a complaint with a data-protection authority.

13. Children's privacy

The Services are not directed specifically at children, and we do not intentionally seek to collect personal information from children. If you are a parent or guardian and believe that a child has provided personal information to us, please contact us so that we can review the matter and, where appropriate, delete the information.

14. Third-party links

The Services may contain links to websites or services operated by third parties. Their privacy practices are governed by their own policies. We are not responsible for the privacy, security or content of third-party services.

15. Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes to our practices, the Services or legal requirements. We will publish the updated version on this website, revise the "Last updated" date and provide any additional notice required by law.
